Service Description: Represents eligible refugee claimants at hearings before the Immigration and Refugee Board, and on applications to the Federal Court
  • claimants must obtain Legal Aid certificate
Services can include:
  • assisting with Basis of Claim and related forms to claim refugee status.
  • providing legal representation
  • preparing a written appeal if client is turned down for refugee claim
  • preparing application that asks the Federal Court to decide whether or not there has been a legal mistake if client was turned down or not eligible to appeal
  • preparing motion to delay client's removal from Canada until the Federal Court has made a decision on a judicial review application
  • representing client if the government is trying to take away status as a Convention refugee or protected person
  • helping client prepare a written appeal that asks the government to assess the danger faced in client's country of origin
  • assisting client to write a danger opinion if they were granted Convention refugee or protected person status, but the government is trying to have client removed to their country of origin anyway on the grounds of serious or organized criminality or national security

Application: Intake interview, before or after obtaining Legal Aid certificate
